In accordance with paragraph 19 of the terms of reference of the mechanism for promoting implementation and compliance, the Committee shall consider any submission made to it in accordance with paragraph 9 with a view to determining the facts and root causes of the matter of concern and, assist in its resolution. Paragraph 19 also specifies the kind of advice, non-binding recommendations and information that the Committee may provide a Party with as part of the facilitation procedure, while paragraph 20 specifies the kind of additional measures that the Committee may recommend that the Conference of the Parties decide upon.
Paragraph 9 of the terms of reference specifies who may make submissions to the Committee (self Party trigger, Party-to-Party trigger or limited Secretariat trigger).
In accordance with paragraph 23 of the terms of reference, the Committee shall report to each ordinary meeting of the Conference of the Parties on the work it has carried out to fulfill its functions under paragraphs 19 and 20 for the information and/or the consideration by the Conference of the Parties.
By decision IX/2, the ninth meeting of the Conference of the Parties the decided to enlarge the scope of the Trust Fund to Assist Developing Countries and other Countries in Need of Technical Assistance in the Implementation of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal (Technical Cooperation Trust Fund) and established an implementation fund to assist any Party that is a developing country or country with an economy in transition and is the subject of a submission made in accordance with paragraph 9 of the terms of reference of the Committee.
By decision BC-10/11, the tenth meeting of the Conference of the Parties established the Committee's legal framework programme that aims at providing tailored assistance to Parties, upon request, with a view to ensuring that those requirements of the Basel Convention pertaining to national legislation are adequately implemented. By its decision BC-11/8, the eleventh meeting of the Conference of the Parties invited Parties to make use of the programme.
