The following step-wise approach assists Parties, States and other stakeholders, including generators, exporters, importers and disposers in determining whether the Basel Convention applies to a proposed transboundary movement of wastes.
As first and second steps, it is recommended to verify that the substance or object of the proposed transboundary movement is indeed “waste” as defined by the Basel Convention and a type of waste covered by the Basel Convention.
In a third step, by accessing the Export and Import Control tool, the Parties and other stakeholders will have access to information on the applicable legal requirements, for instance taking into account whether the States involved are Parties or not, whether a national definition of hazardous wastes is in place, and whether there are restrictions or prohibitions pertaining to the import or export of hazardous wastes or other wastes.
