During its thirteenth meeting, the Conference of the Parties decided to include in the work programme 2018-2019 of the Open-ended Working Group that it consider whether to review Annexes II, VIII and IX to the Convention.
Annex II to the Basel Convention lists two categories of wastes requiring special consideration, namely wastes collected from households and residues arising from incineration of household wastes. Annex VIII to the Basel Convention lists wastes contained in this Annex are characterized as hazardous under Article 1, paragraph 1 (a), of this Convention, and their designation on this Annex does not preclude the use of Annex III to demonstrate that a waste is not hazardous. Annex IX to the Basel Convention lists wastes contained in the Annex will not be wastes covered by Article 1, paragraph 1 (a), of this Convention unless they contain Annex I material to an extent causing them to exhibit an Annex III characteristic.
In its decision BC-13/17, the Conference of the Parties also invited Parties and others to submit comments on whether to consider the review of Annexes II, VIII and IX to the Basel Convention, taking into account the approach outlined in Annex II of document UNEP/CHW.12/INF/52. Parties and others were invited to submit such comments in a 2 June 2017 Secretariat letter related to calls for information in follow-up to the decisions taken by the Conference of the Parties to the Basel Convention at its thirteenth meeting.
Comments received in response to the invitation are available in the table below and were made available to the Open-ended Working Group in document UNEP/CHW/OEWG.11/INF/31. Following its consideration of the information, the working Group took note of the comments in its decision OEWG-11/12.
No further work on the review Annexes II, VIII and IX to the Convention was decided by the Conference of the Parties during its fourteenth meeting.
