Procedures and Mechanisms on Implementation and Compliance with the Basel and Rotterdam Conventions

This publication is intended to promote understanding of the procedures and mechanisms for promoting implementation and compliance with the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal (“Basel Convention”) and the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade (“Rotterdam Convention”). It presents a snapshot of the terms of reference of both mechanisms, as well as information on the achievements over the years of the Basel Convention compliance mechanism. The terms of reference of both mechanisms are set out in the annexes to this publication.

This brochure presents a brief overview of the activities of the Implementation and Compliance Committee carried out during the period 2002 – 2011. It complements the brochure entitled “The Basel Convention Mechanism for Promoting Implementation and Compliance” published in 2006, which is intended to be a brief guide for Parties to explain the procedures of the Committee.

The Basel Convention  Mechanism for promoting implementation and compliance

In order to promote understanding of the mechanism for promoting the implementation of and compliance with the obligations set out under the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, the Committee that is entrusted with administering that mechanism (“the Compliance Committee”) decided that it would prepare the present publication - a brief guide for Parties to explain, in clear terms, the procedures of the Committee.

I. Opening of the meeting

1. The ninth meeting of the Implementation and Compliance Committee (‘the Committee’) was held at the International Environment House/Maison Internationale de l’Environnement, Geneva, on 89 November 2012. Ms. Jimena Nieto, Chair of the Committee, opened the meeting at 10.00 a.m. She welcomed Committee members and said that the Committee had a very full agenda ahead of it which would require the Committee to work late. In light of the workload of the Committee, she reminded members that she had, during the eight meeting of the Open-ended Working Group, invited parties to consider providing for a three-day rather than a two-day meeting during the next biennium. She reminded Committee members of the amount of work that had been undertaken through consultations since the tenth meeting of the Conference of the Parties. She thanked those members that had taken part in that work and expressed regret that only a few Committee members had joined these intersessional efforts.

1.The tenth meeting of the Implementation and Compliance Committee (hereinafter ‘the Committee’) was held at the Direction Générale de la Prévention des Risques, Ministère de l'Ecologie, du Développement Durable et de l'Energie, Grande Arche - Paroi Nord 92055 La Défense Cedex, Paris, France, on 5 and 6 December 2013. Ms. Jimena Nieto, Chair of the Committee, opened the meeting at 9.00 a.m. She welcomed Committee members reminded them that the tenth meeting of the Committee came in addition to what had been approved by the Conference of the Parties in the 20122013 programme budget and expressed her appreciation both to Japan, whose financial contribution made the meeting possible, and to France, the host of the meeting.

1. The twelfth meeting of the Implementation and Compliance Committee (hereinafter “the Committee”) was held from 4 to 6 June 2016 at the United Nations Environment Programme (hereinafter ‘UNEP’) headquarters in Nairobi, Kenya. Mr. Juan Ignacio Simonelli, Chair of the Committee, opened the meeting at 10.00 a.m. He welcomed Committee members and, on behalf of the Committee, expressed his appreciation to Japan that provided funding for the meeting. Mr. Simonelli also thanked those Committee members that were making in-kind contributions to the Committee by taking the lead on specific activities of the work programme of the Committee.

I. Opening of the meeting

1. The first part of the fourteenth meeting of the Committee Administering the Mechanism for Promoting Implementation and Compliance (‘the Committee’) was held online from 29 June to 3 July 2020. Mr. Florisvindo Furtado, Chair of the Committee, opened the meeting at 3.00 p.m. He welcomed Committee members and observers and thanked them for participating in the meeting despite the extraordinary circumstances due to the COVID-19 pandemic. On behalf of the Committee, he expressed his appreciation to the governments of Norway and Switzerland for their generous financial contributions to support the work of the Committee. Mr. Furtado also thanked those Committee members that were making in-kind contributions to the Committee by taking the lead on specific activities of the work programme of the Committee.

As referred to in document UNEP/CHW/CC.14/8 on the report of the fourteenth meeting of the Basel Convention Implementation and Compliance Committee (Geneva, online, 29 June3 July 2020), the Committee suspended its meeting at the end of its 3 July 2020 session, it agreed to resume the fourteenth meeting of the Committee for supplementary online sessions from 21 to 25 September 2020 to complete its work. Taking into account developments with the COVID-19 pandemic, it requested to the Secretariat to provide the Committee at the beginning of its resumed sessions in September 2020 with an update on the possibility for the Committee to convene face-to-face sessions prior to the fifteenth meeting of the Conference of the Parties, or after the fifteenth meeting of the Conference of the Parties and prior to 31 December 2021, with a preference for such session to be held back-to-back to possible face-to-face sessions of the twelfth meeting of the Open-ended working Group.
