This brochure presents a brief overview of the activities of the Implementation and Compliance Committee carried out during the period 2002 – 2011. It complements the brochure entitled “The Basel Convention Mechanism for Promoting Implementation and Compliance” published in 2006, which is intended to be a brief guide for Parties to explain the procedures of the Committee.

In order to promote understanding of the mechanism for promoting the implementation of and compliance with the obligations set out under the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, the Committee that is entrusted with administering that mechanism (“the Compliance Committee”) decided that it would prepare the present publication - a brief guide for Parties to explain, in clear terms, the procedures of the Committee.

Eleventh meeting of the Basel Convention Implementation and Compliance Committee

Geneva, Switzerland, from 22 to 24 September 2014

Venue: International Environment House I (IEH-I), room 3, 11-13, Chemin des Anémones, 1219 Châtelaine, Geneva, Switzerland.

Summary of outcomes : The Committee considered 13 specific submissions, general issues of implementation and compliance, and its draft 2016-2017 work programme. With respect to the specific submissions, 9 Parties attended the meeting and the Committee adopted 13 decisions.In its decision pertaining to the self-submission by Central African Republic, the Committee approved this Party’s compliance action plan and recommended that the Executive Secretary use resources in the implementation fund of up to USD 50’000.- to fund activities listed in the plan. The Committee also considered a report on the review of the operation of the implementation fund, including in light of the establishment of the UNEP Special Programme, and recommended that it be entrusted to develop recommendations to the attention of the Executive Board of the Special Programme on priority areas for institutional strengthening under the Basel Convention and that it consider further options to cooperate with the Special Programme. With respect to the extended Secretariat trigger, the Committee recommended to the Conference of the Parties that it confirm without any limitation in time the extension of the Secretariat’s trigger to article 5 issues (designation of Focal Point and Competent Authority) and that the Conference of the Parties extend until COP-14 the Secretariat’s trigger pertaining to national definitions and import/exports restrictions and prohibitions. With respect to general issues of implementation and compliance, the Committee reviewed the classification of parties’ compliance performance with national reporting and how to improve timeless and completeness of reports, and agreed to invite Parties to comment thereon. The Committee also continued its consideration of four draft guidance documents that were consulted with OEWG-9. The Committee agreed to invite further comments on one of these, namely the draft Manual for the implementation of the Basel Convention. The Committee will finalize the four draft guidance documents and submit them to the twelfth meeting of the Conference of the Parties for adoption.

The Committee also prepared the draft 2016-2017 work programme of the Committee. Proposed activities pertain to improving implementation and compliance with respect to national reporting, the control system, illegal traffic, insurance bond guarantee, and national legislation. In addition, the Committee is proposing that it be mandated to review and update as needed the guidance documents it has developed.

During its eleventh meeting, the Committee invited Parties and others to provide comments on the Manual for the implementation of the Basel Convention and the classification of Parties’ compliance performance with national reporting.
